A six-month old baby placed in foster care after his mum was arrested for child neglect was found dead after being left with a known criminal.
Scorpio Sharp’s mother Roxanne Raphael was arrested for child neglect earlier this year, and local child services said the “only available option” they could find was to place the tot in the care of 25-year-old Ricky Tubbs.
Tubbs had passed necessary background checks but failed to tell child services that another woman, 41-year-old Tanya Galvin, 41, also lived at the property in Cape Canaveral, Florida.
Galvin had violated the terms of her probation on grand theft charges by moving in with Tubbs without alerting authorities.
Police discovered the boy’s death on March 1 after Deputy Roldano Rivera noticed three children between the ages of 2 and 4 wandering around outside the property apparently unsupervised, reports the Orlando Sentinel.
According to a report from the Brevard County Sheriff’s Office, when deputies tried to knock on the door they found it had been left open and found Galvin asleep inside.
The police officers asked permission to look around the home in order to find a clean nappy and clothing for the two-year-old, who smelled strongly of urine. On entering the children’s bedroom Deputy Kimberly Reites noticed a plastic storage container – inside it was little Scorpio’s body.
Deputy Reites did her best to revive the infant but despite her efforts he was later pronounced dead.
While she was performing CPR on the little lad Deputy Reites noticed a quantity of water coming from the boy’s lungs.
Autopsy results found that he had drowned.
On the night before the boy died, Tubbs had reportedly left the children while she went out for the evening.
Tubbs, who had been drinking alcohol and taking drugs, did not return before her boyfriend was due to start work the following day so he left the children in Galvin’s care.
It was later determined that Galvin had attempted to bathe Scorpio, he had died in the bathroom where his wet clothes remained on the floor, but Galvin had placed his body in a plastic box in the bedroom.
Galvin and Tubbs were both arrested on Friday.
Galvin is charged with Aggravated Manslaughter of a Child and Violation of Probation.
She is being held at the Brevard County Jail on a No Bond status.
Tubbs was charged with Neglect of a Child with Great Bodily Harm. She is currently being held at the Volusia County Jail on a bond of $25,000 awaiting extradition to Brevard County.
