Senator Sheldon Whitehouse (D., RI) called Judge Naomi Rao ‘a cartoon of a fake judge’ after judging that the judge who presided over Michael Flynn’s case should explain why he did not comply with the government’s request for the drop business.

Rao joined circuit judges Karen LeCraft Henderson and judge Robert L. Wilkins on Thursday to order Rate Emmet Sullivan to respond to Flynn’s request that the DC circuit comply with the Justice Department’s motion to withdraw the case within ten days.
After the DOJ said that “newly discovered and disclosed information” changed its opinion of Flynn’s plea in 2017, Sullivan postponed the matter, allowing third parties to weigh in. He also appointed an external party to “present opposition arguments” against the DOJ’s motion, including the possibility that Flynn could be charged with perjury or contempt.
Rao was appointed a member of the D.C. circuit in March 2019 and received one “Well qualified” assessment by the American Bar Association after President Trump nominated her.
Whitehouse’s comments immediately came back from fellow Senate Commissioner Mike Lee (R., Utah), who defended Rao as “a gifted, hardworking lawyer and jurist.”
