A division bench of two of the country’s top judges, Hemant Gupta and V Ramasubramanian, ruled that the doctors could not be blamed even if the patient died. Because no doctor can kill his patient on purpose. Again, no doctor can guarantee the patient’s survival even after 100 percent effort.

Justice Corona, referring to the situation, said doctors and nurses risked their lives during the epidemic. Then if a patient dies in this way, it is not right to beat the doctors.

Incidentally, Dinesh Joyswal died in June 1997 due to a failed gangrene operation. The family of the deceased then blamed negligence on surgical management, absence of a senior doctor, lack of operating theater and a broken angiography machine for Jaiswal’s death. The hospital has denied all allegations.
